Participant Rights and Grievance Process
In the event a participant and/or his/her guardian suspects any rights of the participant have been violated, they should contact the program to file a grievance. The grievance process is initiated when the participant or guardian notifies the program. Once reported, ResCare and ResCare Premier policies and procedures governing suspected abuse, neglect, and exploitation will be followed. This includes suspending without pay all employees against whom allegations have been made and conducting an internal investigation. ResCare Premier will report all substantiated incidents of abuse, neglect, or exploitation to appropriate licensing agencies, regulatory agencies, certifying entities, and/or law enforcement agencies. If the complaint is related to a staff member's misconduct and is substantiated, disciplinary action will be taken. This action will vary according to the severity of the incident. Training specific to the incident may be required and additional disciplinary action, up to and including termination, may be imposed. Additionally, participants may contact state or provincial regulating agencies to file a grievance.
